1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of plotiz.com, our web and mobile interfaces, any Plotiz software development kits or application programming interfaces (collectively, the "Services"), and the manufacture and delivery of customized physical goods (the "Products"). By creating an account or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes both you and that organization.

2. Eligibility and accounts

You must be 18+ to create an account or place orders. The Services are not directed to children under 13. Adults may create content for children; if we learn that a child has created an account, we will delete it unless verifiable parental consent is obtained. See our Privacy Policy.

You are responsible for your account credentials and for all activity under your account.

3. Key definitions

Generations – Outputs produced through the Services, including text, stories, images, illustrations, layouts, designs, and print-ready files.

Products – Physical goods manufactured from Generations (e.g., books, puzzles, apparel, stickers, journals, coloring kits, wall art).

Credits – Units used to access certain features or runs (e.g., image or book generation).

Fulfillment partners – Third-party manufacturers, printers, and logistics providers that produce and ship Products on our behalf.

4. Ownership of Generations (you own), and your license to Plotiz

As between you and Plotiz, and to the fullest extent permitted by law, you own your Generations, including for commercial use, subject to these Terms and to any rights of third parties in your prompts or uploads. Different jurisdictions treat AI-assisted works differently; you are solely responsible for determining how you may rely on IP rights in your outputs.

You grant Plotiz and our fulfillment partners a limited, worldwide, royalty-free license to host, cache, process, reproduce, adapt, print, manufacture, display, and distribute your prompts, uploads, Generations, and Product specifications solely to operate the Services; fulfill, deliver, and support orders; provide previews; detect and prevent abuse; comply with law; and improve safety and quality where permitted by law and your settings (see Privacy Policy).

4.1 Promotional use (opt-in)

We will not publicly showcase your Generations or Products for marketing unless you explicitly opt in. If you opt in, you grant Plotiz a non-exclusive license to display your Generations, Product photos, descriptions, and your name/handle for promotional purposes. You may revoke this opt-in at any time; revocation does not require removal of materials already published but applies going forward.

5. Your responsibilities; acceptable use

You are responsible for your prompts, uploads, Generations, and use of the Services. You agree not to:

• Infringe others' rights—including copyrights, trademarks, publicity or moral rights—such as by requesting or using protected characters, brands, or logos without permission.
• Create or share unlawful or harmful content, including content that is illegal; exploits or harms minors; is obscene, harassing, or defamatory; promotes violence or self-harm; or invades privacy.
• Reverse engineer, copy, scrape, or build a competing service using access to the Services; use bots or automated tools except through approved APIs/SDKs.
• Interfere with or degrade the Services, evade usage limits, or defeat security.
• Misrepresent affiliation with Plotiz or imply endorsement.

We may remove or refuse to process content or orders that violate these Terms or law and may suspend or terminate accounts for repeated or egregious violations.

6. Third-party services; SDK and APIs

Some features rely on third-party providers (e.g., cloud hosting, payment processing, analytics, and print-on-demand partners). Your use of payments and certain integrations may be subject to their terms. Access to any Plotiz SDK or APIs (if enabled) is subject to separate terms; you may not use them to replicate core functionality or to offer a substantially similar service. Stripe participates in the EU-U.S. Data Privacy Framework.

7. Plans, billing, and Credits

We may offer free, trial, and paid plans. Plan features, usage caps, and Credits are disclosed at purchase and in your account.

Billing & renewal. Subscriptions bill monthly in advance and auto-renew until canceled.

Cancellation. You can cancel anytime; access continues through the paid period. Except where required by law, fees are non-refundable, and partial periods aren't credited.

Credits. Unless stated otherwise, unused Credits expire at the end of the billing cycle, with up to 50% rolling over once to the next month. Credits have no cash value, are non-transferable, and are forfeited upon cancellation.

Price changes. We may change prices prospectively with reasonable notice (e.g., email or in-product). Continued use after the effective date constitutes acceptance.

8. Orders, manufacturing, and shipping

Plotiz routes orders to a network of vetted print-on-demand partners based on cost, quality, capacity, and destination. Estimated delivery dates are projections, not guarantees. Title and risk of loss transfer to you on delivery to the carrier unless applicable law or a written agreement states otherwise. Parties may allocate risk of loss by contract.

8.1 Personalized Products: returns & replacements

Products are personalized and made to order, so returns are not accepted. If a Product arrives defective, misprinted, or damaged, contact us within 7 days of delivery with photos and order details; we will, at our discretion, replace the item or issue a refund/credit. We are not responsible for errors caused by user-provided content (e.g., typos, low-resolution images) or incorrect shipping addresses, or for delays or loss outside our control after transfer to the carrier.

8.2 Taxes and duties

Prices are typically shown exclusive of taxes. You are responsible for applicable sales/use tax, VAT/GST, import duties, and similar levies, unless we are required to collect and remit them, in which case estimates will be shown at checkout.

9. Payment processing

Payments are processed by third-party providers (e.g., Stripe). Your use of their services is subject to their terms and privacy policies. We do not store full payment card numbers.

10. Feedback

If you provide ideas or suggestions, you grant Plotiz a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

11. Beta features

We may offer alpha or beta features. They are provided as-is, may change or end at any time, and may be subject to additional terms.

12. Disclaimers

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLOTIZ AND ITS AFFILIATES AND SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT GUARANTEE THAT GENERATIONS WILL BE ERROR-FREE, UNIQUE, OR FREE FROM THIRD-PARTY CLAIMS, OR THAT MANUFACTURING, FULFILLMENT, OR SHIPPING WILL BE UNINTERRUPTED OR TIMELY. (See §8 for risk of loss.)

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLOTIZ AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF US$500 OR THE AMOUNTS YOU PAID TO PLOTIZ FOR THE SERVICES THAT GAVE RISE TO THE CLAIM DURING THAT PERIOD. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS IN THIS SECTION; THOSE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You will defend, indemnify, and hold harmless Plotiz and its affiliates, officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your prompts, uploads, Generations, or Products; (b) your breach of these Terms or applicable law; or (c) any claim that your content infringes or violates a third party's rights.

15. Suspension and termination

We may suspend or terminate your access for violations of these Terms, suspected fraud or abuse, legal compliance, or risk to the Services. You may terminate at any time by closing your account. Sections that by their nature should survive (including §§4–6 and 11–20) survive termination.

16. Changes to the Services or Terms

We may modify the Services and these Terms from time to time. If we make material changes, we will provide notice (e.g., email or in-product). Changes apply prospectively. If you disagree, you must stop using the Services and cancel any subscription.

17. Export control and sanctions

You may not use the Services if you are located in a jurisdiction subject to comprehensive U.S. sanctions or are on a U.S. government restricted list. You will comply with applicable export control and sanctions laws.

18. Governing law and dispute resolution

18.1 Governing law

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. (Delaware is a common choice for U.S. tech companies; note that other states—especially California—may scrutinize forum selection and jury-trial waivers for resident consumers.)

18.2 Informal resolution

Before filing a claim, you agree to email hello@plotiz.com with a brief description of the dispute and to attempt in good faith to resolve it informally within 30 days.

18.3 Binding arbitration; class-action waiver

Any dispute that we cannot resolve informally will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, conducted by video conference or, if in person, in San Francisco, California, in English. CLASS ACTIONS AND CLASS ARBITRATIONS ARE NOT PERMITTED. Each party pays its own fees; the arbitrator may award fees and costs to the prevailing party where permitted by law. Courts have generally enforced class-action waivers in arbitration agreements, but enforceability can vary by jurisdiction and context.

Either party may bring an individual action in small-claims court if eligible or seek temporary injunctive relief in court to protect intellectual-property rights or prevent unauthorized access to the Services.

18.4 Venue

Subject to §18.3, for any permitted court action the state and federal courts located in San Francisco County, California have exclusive jurisdiction, and you consent to their personal jurisdiction.

19. Notices

We may provide notices to the email address associated with your account or by posting within the Services. You agree that such electronic notices satisfy any legal communication requirements.

20. Miscellaneous

These Terms are the entire agreement between you and Plotiz regarding the Services and supersede prior agreements on the subject. They do not create third-party beneficiary rights. If any provision is unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain in effect. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver.
